You might have known that there has been a severe increase in bombing threats to airlines recently. This prompted the Union Civil Aviation Minister K Ram Mohan Naidu to make an announcement on Sunday. The government is considering a ban on individuals who issue hoax bomb threats. They will do so with the support from law enforcement, international agencies, and the Intelligence Bureau. The Aviation Minister also stated that amendments to two Civil Aviation Laws are under consideration.
PTI quoted its sources, and mentioned that a minimum of 50 Air India flights were under surveillance. This was because they all received bombing threats on Sunday. In the last 14 days, over 350 flights operated by Indian carriers received bomb threats. They were mostly issues through social media, which made matters even more severe.
“We are also taking the support of international agencies, law enforcement agencies, the Intelligence Bureau to prevent these. We are planning to bring changes to two civil aviation laws. Those who resort to these kinds of activities will be punished severely and imposed a penalty. We are also taking steps to ban such persons from flying. We will announce them in the coming days,” he mentioned in the statement. In response to recent hoax bomb threats targeting multiple airlines, the IT Ministry has partnered with the international social media giants. They instructed social media platforms to uphold due diligence. This included removing or blocking access to misinformation within the timelines outlined in IT rules.
Additionally, the Ministry emphasised that social media intermediaries have further responsibilities. This was under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), which requires them to report specific offences related to the country’s safety compulsorily.
The government issued an advisory reminding social media intermediaries of their obligation under IT rules. It was to provide relevant information and assist investigative agencies within a 72 – hour timeline.
The IT Ministry issued advisory mentioned that, “In addition to the above, the IT Rules, 2021 obligates the intermediaries to provide information under its control or possession, or assistance to the Government agency which is lawfully authorised for investigative or protective or cyber security activities, for the purposes of verification of identity, or for the prevention, detection, investigation, or prosecution, of offences under any law for the time being in force, or for cyber security incidents, well within the stipulated time frames (as soon as possible but not later than 72 hours).”
“As part of such due diligence obligations, it is the responsibility of concerned intermediaries including social media intermediaries to promptly take necessary action under the IT Rules, 2021 by not allowing any user to host, display, upload, modify, publish, transmit, store, update or share any unlawful or false information.”
“Further, the exemption from liability for any third party information, data, or communication link made available or hosted by social media intermediaries as provided under section 79 of the IT Act shall not apply if such intermediaries do not follow the due diligence obligations as prescribed under the IT Act read with IT Rules, 2021 or abetted or aided, in the commission of the unlawful act.”
